Overview

This guide explains, in general terms, what a foreign buyer should know before purchasing property in Georgia. It is not legal, tax, or immigration advice — confirm your specific situation with a qualified Georgian legal professional before proceeding.

Ordinary (non-agricultural) property

Foreign individuals and foreign-registered entities can generally acquire apartments and other immovable property that is not subject to Georgia's special agricultural-land ownership restrictions. This covers most residential apartments, houses on non-agricultural land, and commercial units.

Agricultural land restrictions

Agricultural land is subject to a separate, restrictive legal regime under the Organic Law of Georgia on Agricultural Land Ownership. In general terms: a foreign individual may own agricultural land where it was acquired by inheritance. A Georgian-registered private-law legal entity whose dominant partner is a foreigner and/or a foreign-registered legal entity may own agricultural land on the basis of an investment plan and a decision of the Government of Georgia, subject to the statutory regime. Do not assume a property is or isn't agricultural land — the registered designation must always be individually verified before committing to a purchase.

Checking a property's registered designation

Before making an offer, confirm the property's registered land category and cadastral information through the Public Registry or your legal representative — this determines which ownership rules actually apply, and mistaken assumptions here can derail a transaction late in the process.

Property ownership and residency are separate

Buying property does not automatically grant Georgian residence. Georgian law provides a separate short-term residence-permit route for certain foreign owners of qualifying non-agricultural immovable property, subject to statutory eligibility and valuation requirements — the market-value threshold in the current consolidated legislation is USD 150,000 equivalent in GEL, effective from 1 March 2026. Thresholds and rules can change; verify the current requirements with the responsible Georgian authority before relying on property ownership for immigration purposes.

Due diligence as a foreign buyer

The same due-diligence practices apply as for any buyer — see our Buyer Due-Diligence Checklist and Property Document Checklist — with extra attention to the land-designation check above. Consider engaging an independent Georgian lawyer, particularly if you cannot be present in Georgia throughout the transaction.

Public Registry registration

Ownership is registered with Georgia's Public Registry (NAPR). Buying remotely / power of attorney

If you cannot be physically present, a power of attorney can authorise a representative (often a lawyer) to act on your behalf for specific steps. The exact procedural requirements for a power of attorney to be valid and accepted in a Georgian property transaction have not been independently verified by Access Home — confirm this directly with a Georgian legal professional before relying on a remote-purchase plan.

Currency and payment

Georgian property transactions are typically conducted in GEL, though listings may reference other currencies for indicative purposes. NAPR's own Smart Contract pathway, where used, specifies the purchase amount in GEL through an escrow arrangement. Financing as a foreign buyer

Mortgage/financing eligibility for foreign buyers varies by bank and individual circumstances. Access Home does not guarantee financing approval — confirm your eligibility and terms directly with a Georgian bank or lender before relying on financing to complete a purchase.

Tax: purchase vs. ownership vs. resale

Keep these separate: the one-off cost of registering your purchase (see Total Cost to Buy), ongoing annual property tax if applicable, and any future resale tax if you later sell. Risks and red flags

Be cautious of: pressure to pay before verifying land designation and title, sellers unwilling to provide registration/cadastral information, prices significantly below comparable listings with no clear explanation, and any request to pay outside the documented transaction terms. When in doubt, pause and get independent legal advice.

Questions to ask before committing

Is this property's land registered as agricultural or non-agricultural? Can I see the cadastral code and current registration extract? Are there any encumbrances? What is the full payment schedule and what happens if I miss a payment (for off-plan)? What registration costs will I be responsible for? Can you provide documentation of your authority to sell/represent this property?
